2. Eligibility

You must:

• Be legally capable of entering into a binding contract
• Provide accurate and complete registration information

We reserve the right to suspend or terminate accounts where false or misleading information is provided.

3. Membership & Subscription Services

TRACD provides subscription-based access to digital content, member services and related materials as described on our website.

Subscription details, pricing, billing frequency and included features are clearly displayed prior to purchase.

We reserve the right to modify subscription plans or pricing upon reasonable notice.

4. Payment & Billing

4.1 Third-Party Payment Processing

All subscription payments are processed securely via an independent third-party payment service provider (“Payment Processor”).

Caldwell National Limited:

• Does not store, process, or have access to full debit or credit card details
• Does not directly handle payment card information
• Relies on the Payment Processor to process transactions securely and in compliance with applicable payment security standards (including PCI-DSS)

When making a payment, your payment information is submitted directly to the Payment Processor and is subject to their own terms and privacy policy.

We may receive limited transaction information from the Payment Processor such as:

• Payment confirmation
• Transaction reference number
• Payment status
• Limited card identifier (e.g. last four digits)

4.2 Recurring Billing

Subscriptions are billed in advance on a recurring basis (monthly or annually as selected).

By subscribing, you authorise the Payment Processor to charge your selected payment method automatically unless and until you cancel.

If a payment fails or is declined, we may suspend access to services until payment is successfully processed.

5. Consumer Cancellation Rights (14-Day Cooling Off Period)

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013:

You have the right to cancel your subscription within 14 days of purchase.

However, if:

1. You request immediate access to digital content during this period, and
2. You acknowledge that doing so may waive your cancellation right,

Then your right to cancel may be lost once digital content access has commenced.

6. Ongoing Cancellation

You may cancel your subscription at any time via your account dashboard or by contacting us.

Unless otherwise stated:

• Cancellation takes effect at the end of your current billing cycle
• No partial refunds are provided outside the statutory cooling-off period

7. Acceptable Use

You agree not to:

• Share login credentials
• Reproduce or distribute content without permission
• Use the platform for unlawful or abusive purposes
• Attempt unauthorised system access

We reserve the right to suspend or terminate accounts for breaches.

8. Intellectual Property

All website content, branding, materials, and digital resources are the property of Caldwell National Limited unless otherwise stated.

No content may be copied or reproduced without written permission.

9. Limitation of Liability

Nothing in these Terms excludes liability for:

• Death or personal injury caused by negligence
• Fraud or fraudulent misrepresentation
• Any liability that cannot be excluded under UK law

To the fullest extent permitted by law, we are not liable for indirect or consequential loss. Our total liability shall not exceed the subscription fees paid in the preceding 12 months.

11. Governing Law

These Terms are governed by the laws of Jersey, Channel Islands. Disputes shall be subject to the exclusive jurisdiction of the courts of Jersey, Channel Islands.
